Accident in a Company Car: Who Claims What
The vehicle is not yours, so who claims for it, and what can you claim for yourself?
Your employer claims for the vehicle, because they own it. You claim for yourself - injury, your own property damaged, and any losses you personally suffered.
You may also be entitled to a replacement vehicle if your employer cannot provide one and you need it.
What is different about a company car claim
Ownership decides who claims what. The registered keeper claims the vehicle damage; you claim what you personally lost.
It matters because people frequently assume that because the car is not theirs, there is nothing for them to claim. There usually is - and the two claims run alongside each other without conflict.
What you can claim
Injury
Yours to claim, entirely separate from the vehicle.
Personal property
Phone, glasses, laptop or clothing damaged in the collision.
Loss of earnings
If you were unable to work while recovering.
A replacement vehicle
Where your employer cannot provide one and you genuinely need it.

What you would normally be charged - and what you pay us
These charges are rarely explained up front, and the first many people hear about the daily rate is when an invoice arrives.
Here is what they typically look like against what you pay with us:
| Charge | Typical provider | PTH Claims |
|---|---|---|
| Recovery from the scene | £150 - £350 | FREE |
| Secure storage, per day | £15 - £40 | FREE |
| Replacement vehicle, per day | £40 - £150 | FREE |
| Total cost to you | Often four figures | £0 |
Terms and conditions apply. Typical provider figures are industry ranges and vary by provider, location and circumstances. All claims are subject to identity, fraud and anti-money laundering checks.
With PTH Claims that figure is zero. We carry the cost and recover it from the at-fault driver’s insurer. It never reaches you, and it never depends on how your claim ends.

Common questions
Yes, straight away. It is their vehicle and their insurance, and most contracts require it.
You may still have a claim for personal property damaged and any out-of-pocket costs, even if the vehicle claim is your employer’s.
A genuine non-fault accident should not. The claim is against the other driver, not against your employer.
That depends on your employment contract and the company car policy. Check what you signed. Where the accident was not your fault, the excess is recoverable from the other side.
Possibly, where your employer cannot provide one and you genuinely need a vehicle. Tell us the circumstances.
Terms and conditions apply to all services described on this page. Free recovery, storage and replacement vehicles are provided on the basis that the charges are recovered from the at-fault party’s insurer. We will explain the terms in plain English before anything is arranged.
Before we act for you we are required to verify your identity and to carry out fraud and anti-money laundering checks. This may include checks with credit reference and fraud prevention agencies, which will leave a record on your file.
Where fraud is suspected, information may be shared with fraud prevention agencies, insurers and law enforcement. Providing false or misleading information in support of a claim may mean your claim is refused, and can be a criminal offence.
