No Witnesses to My Accident. Can I Still Claim?
It is your word against theirs and nobody else saw it. That is far from hopeless - most claims are decided on evidence other than witnesses.
Yes. Witnesses help, but most claims are decided on physical evidence - where the damage is, how the vehicles ended up, and what each driver said.
The pattern of damage is often more reliable than a bystander. A rear-end impact tells its own story regardless of who was watching.
Evidence that carries real weight
Witnesses are only one source, and often not the strongest:
Where the damage is
Impact points and angles frequently establish who hit whom, whatever is claimed.
Dashcam footage
Yours, theirs, or another vehicle nearby. Often decisive on its own.
CCTV and doorbell cameras
Junctions, shops, buses and homes. Usually overwritten within days, so it must be requested fast.
The accounts given
Inconsistencies between what a driver said at the scene and later carry considerable weight.
What to do now
The first week matters more than anything that follows:
Photograph everything
Both vehicles from several angles, the road layout, signs, markings, skid marks and the weather. Wide shots as well as close-ups.
Chase footage immediately
Ask nearby premises for CCTV in writing straight away. Most systems overwrite within seven to thirty days.
Write it down while it is fresh
Your account of speeds, positions and what was said, dated today. Memory fades quickly and a contemporaneous note is evidence.
CCTV is the piece people lose. By the time a claim is a month old, most footage is gone. If there is any chance a camera saw it, ask today.
Other driver denying it?
Do not assume it is your word against theirs. Tell us what happened and we will tell you what evidence is worth chasing.
If liability ends up split
Sometimes the evidence genuinely points both ways and liability is shared - often 50/50, sometimes 75/25 or another division.
A split does not end your claim. You recover that proportion of your losses. Seventy-five per cent of a properly evidenced claim is usually a great deal more than accepting an early denial and walking away.
Common questions
Rarely. Damage patterns, vehicle positions, road layout and the consistency of each account usually give a clear picture without a witness.
Commonly seven to thirty days, sometimes less. Request it in writing immediately - this is the single most time-critical thing you can do.
Yes. Note exactly what was said, when, and who heard it. Changing accounts damage credibility when liability is assessed.
If police attended, it is worth obtaining. They do not attend most minor collisions, and a claim does not depend on it.
A registration is usually enough to trace the insurer. If the vehicle turns out to be uninsured, the Motor Insurers’ Bureau route may apply.
Terms and conditions apply to all services described on this page. Free recovery, storage and replacement vehicles are provided on the basis that the charges are recovered from the at-fault party’s insurer. We will explain the terms in plain English before anything is arranged.
Before we act for you we are required to verify your identity and to carry out fraud and anti-money laundering checks. This may include checks with credit reference and fraud prevention agencies, which will leave a record on your file.
Where fraud is suspected, information may be shared with fraud prevention agencies, insurers and law enforcement. Providing false or misleading information in support of a claim may mean your claim is refused, and can be a criminal offence.
