Privacy policy
This explains what personal information PTH Claims Limited collects, why we need it, who we share it with and what rights you have over it.
We collect what we need to run your claim and nothing beyond it. We share it with the people who have to see it, such as the at fault insurer, engineers and repairers. We do not sell your data and we never will.
PTH Claims Limited is the data controller. Company number 14558278. ICO registration ZB633381.
1. Who we are
PTH Claims Limited, registered in England and Wales, company number 14558278, of Grosvenor House, 11 St Pauls Square, Birmingham B3 1RB. We are registered with the Information Commissioner’s Office under reference ZB633381.
For anything in this policy, contact us at claims@pthclaims.com or on 0121 516 6441.
2. What we collect
The information we hold depends on how far a claim goes. In a typical claim it includes:
- Identity and contact details. Name, address, date of birth, phone number, email address.
- Driving and vehicle information. Driving licence details, vehicle registration, make, model, mileage and condition.
- Insurance details. Your policy, your insurer, and the details of the other party and their insurer.
- Accident circumstances. Date, time, location, what happened, photographs, dash camera footage, witness details and police reference numbers.
- Financial information. Bank details where a payment is due to you, and details of losses being claimed.
- Identification documents. Copies of documents provided to verify your identity, as we are required to do.
- Correspondence. Emails, letters, notes of telephone calls and messages relating to the claim.
Where an injury is involved, information about your health is special category data and is treated with additional care. In most cases that information goes to the solicitor acting for you rather than to us.
3. Why we use it, and our lawful basis
- To perform our contract with you. Arranging recovery, storage, a replacement vehicle and repairs, and pursuing the at fault insurer.
- To comply with legal obligations. Identity verification, fraud prevention, anti money laundering checks, tax and accounting records.
- For our legitimate interests. Recovering sums owed to us, preventing and detecting fraud, keeping records to defend a legal claim, and improving how we run.
- With your consent. Where we send you marketing, which you can withdraw at any time.
4. Who we share it with
We share only what is necessary, and only with organisations that need it to progress your claim:
- The at fault driver’s insurer, and their solicitors or agents.
- Your own insurer, where relevant to the claim.
- Recovery operators, storage sites, vehicle hire suppliers and repairers.
- Independent engineers and vehicle assessors.
- Solicitors instructed in connection with your claim, including any solicitor acting for you on an injury claim.
- Credit reference and fraud prevention agencies.
- Courts, the police and regulators, where we are required or permitted to do so by law.
- Our own professional advisers, auditors and IT suppliers.
We do not sell your personal data, and we do not pass it to third parties for their own marketing.
5. Fraud prevention checks
Before we act for you we are required to verify your identity and carry out fraud and anti money laundering checks. This may include searches with credit reference and fraud prevention agencies, which will leave a record on your file. Where fraud is suspected, information may be shared with fraud prevention agencies, insurers and law enforcement, and may affect your ability to obtain insurance or credit in the future.
6. How long we keep it
We keep claim files for seven years from the date a claim closes. That reflects the periods in which a legal claim can be brought against us or by us, and our tax and accounting obligations. Enquiries that do not become claims are deleted within twelve months. Identity documents are kept for five years after the end of the business relationship, as required by anti money laundering rules.
7. Where your data is held
Your data is held on systems within the United Kingdom and the European Economic Area. Where a supplier processes data outside those areas, we make sure appropriate safeguards are in place, such as an adequacy decision or standard contractual clauses.
8. How we protect it
Access to claim files is restricted to staff who need it, protected by individual accounts, strong passwords and two factor authentication. Access is logged. Data is encrypted in transit. We review these arrangements regularly.
9. Your rights
Under UK data protection law you have the right to:
- Access the personal data we hold about you.
- Rectify it if it is inaccurate or incomplete.
- Erase it, where we no longer have a lawful reason to hold it.
- Restrict how we use it in certain circumstances.
- Object to processing carried out for our legitimate interests, and to direct marketing at any time.
- Portability, receiving your data in a machine readable format.
- Withdraw consent where processing is based on it.
To exercise any of these, email claims@pthclaims.com. We will respond within one month. There is no charge. Some rights are limited where we are required by law to keep information, for example fraud prevention and accounting records.
10. Cookies
